A three-judge bench at the High Court has quashed the Housing Levy proposed in the 2023 Finance Bill.
In their ruling delivered on Tuesday at the Milimani Law Courts in Nairobi, Justices David Majanja, Christine Meoli and Lawrence Mugambi said the collection of Housing Levy only from salaried employees is discriminatory and unconstitutional.
The judges said the government failed to provide an explanation for the imposition of the levy which must be supported with a rational explanation.
