Both Divisions of the Court are
set for the long end of year sessions resuming this week. The First
Instance Division, which has line a number of cases, will start its
sessions this week on
Tuesday, 29th and go up to 6th December, 2019 while the Appellate Division will also set off two weeks later on 12th November up to 26th November 2019.
The First Instance Division in
total will handle 28 matters before it and among these are: nine (9)
References, five (5) Applications, 10 scheduling conferences, two (2)
Judgments and two (2) Rulings. The bench for the First Instance Division
will be composed of Honourable Justices Lady Justice Monica Mugenyi
(Principal Judge), Justice Dr Faustin Ntezilyayo (Deputy Principal
Judge), Justice Audace Ngiye, Justice Dr. Charles Nyawello and Justice
Charles Nyachae.
The Appellate Division in total
will handle seven (7) matters only among them four (4) scheduling
conferences, one (1) hearing, one (1) Ruling and one (1) Arbitration.
The Appellate Division bench will be composed of Honourable Justices. Dr
Emmanuel Ugirashebuja (President), Justice Liboire Nkurunziza (Vice
President), Justice Aaron Ringera, Justice Geoffrey Kiryabwire and Lady
Justice Sauda Mjasiri.
The three applications coming up for hearing tomorrow 29th October,
2019 before the First Instance Division, arise from a case challenging
the Uganda Constitution (Amendment) Act, 2018, which was filed by a
resident of Kampala, a one Mabirizi K. Kiwanuka vs the Attorney General
of the Republic of Uganda.
Among the Applications to be
heard, Application No.5, is seeking for an interim order restraining the
Government of Uganda, its agencies, bodies, Commissions and any setting
from implementing any of the provisions of the Uganda Constitution
(Amendment) Act, 2018 and halt the implementation of the Uganda
Electoral Commission Strategic Plan and Road Map for 2020/2021 electoral
period or any related plans and also to halt all the processes or
preparations for 2020/2021 general election including but not limited to
undertaking any step in pursuit of amendments to the electoral laws to
align with the Uganda Constitution
