The
magistrate instructed the IGP to arrest Maj Gen Kyaligonza, his two
aides; Cpl Peter Busindiche and Private John Okurut, and present them in
court on June 24 for plea taking after the three repeatedly snubbed
court summons.
Kyaligonza's lawyers insist their
clients are being tried by the General Court Martial and therefore
cannot be in Mukono Magistrate’s Court at the same time.
Mr Jamir Mukama told court that his client, Maj Gen Kyaligonza has failed to appear in Mukono Court because a similar case was instituted in the army court
Mr Muwaganya also noted that Maj Gen Kyaligonza’s name is not on the charge sheet in the case before the General Court Martial because he is retired from the army and therefore his failure to respond to criminal summons is a sign of contempt of court.
Gen Kyaligonza is alleged to have assaulted Ms Esther Namaganda, a traffic Officer on February 24, 2019 in Seeta, Mukono District.
His aides are facing three charges of common assault, obstructing a police officer and assault causing bodily harm.

Ms Namaganda on Monday filed a separate case in the High Court Civil Division seeking compensation of more than Shs200m for special and general damages saying she was embarrassed and spent a lot of money for her treatment following the injuries occasioned to her by Maj Gen Kyaligonza and his aides who are serving UPDF officers.
