The Kisutu Resident Magistrate's Court
Senior Resident Magistrate Cyprian Mkeha read the verdict after the
accused pleaded guilty of the offence and agreed to have committed such
an offence.
Reading the verdict Mkeha convicted the accused in the first
offence of exporting money to China and fined them 10m/- each or a
prison sentence of five years. The accused were also ordered to pay a
fine of 20m/- or face five years in jail in the second offence.
Magistrate Mkeha ordered that on the third count the accused pay a fine of 20m/- or face one year in jail.
He said that on the third count, since the money was not yet
transported to China it meant that their offence was attempted exporting
of the said money.
He also ordered the prosecution to return the 20m/- which the
accused Ning was arrested in possession of, because it was his legal
money.
Until 3.00 PM, the accused were still at the court.
The accused were charged under Regulation 10 (a) of the Foreign
Exchange Regulations GN No. 629 of 1998 read together with Section 12
(2) (a) and (3) of the Foreign Exchange Act.
Earlier, it was alleged that between August 15 and 31, last year,
at the airport, the two accused persons transported to China 10,000
Tanzanian notes of five hundred denominations each, all valued at
5m/-without a permit from the Bank of Tanzania (BoT) governor.
It was alleged that the two accused persons committed a similar
offence involving a similar amount between December 22 and 31, last
year.
The court heard further that on March 15, this year, at the
airport, the accused persons attempted to transport to China 40,000
notes of five hundred denominations each worth 20m/-.
If the accused fail to pay the said fines, they will be forced to spend five years in jail as their sentences run concurrently.
