Mr Omondi’s name featured on the list of shame Uhuru presented to Parliament March last year.
The Ethics and Anti-Corruption Commission (EACC) has closed the investigations into alleged irregular acquisition of land belonging to Kenya Commercial Bank (KCB) by former Raila Odinga’s aide Mr Caroli Omondi.
Mr Omondi’s name featured on the list of shame presented to Parliament by President Uhuru Kenyatta in March last year.
It was alleged that he had fraudulently bought a parcel of land on Loita Street, Nairobi, from KCB at a cost of Sh260 million and was in the process of selling the same to another businessman for Sh650 million.
However, both EACC and DPP found the property in question was sold by KCB to Ms Peris Nasimiyu through a nominee company, Sirios Holding, following a consent ordered by a court on January 10, 2011.
In a letter dated March 18, the EACC’s director of investigations Mr Abdi Mohamud said that after investigations, they forwarded the file to the Director of Public Prosecutions (DPP) who concurred with their recommendation.
“The matter has therefore been closed and the Commission will not pursue it anymore,” said the head of investigations.
The DPP, in his letter dated March 9, said he had carefully perused the resubmitted inquiry file and was satisfied that there was no evidence that Mr Omondi participated in the purchase of the property as alleged.
“Further, there is no evidence that the sale of the subject property by the Kenya Commercial Bank was illegal in any way. Accordingly, I accept the recommendation by the EACC that the file be closed,” the DPP wrote
“The matter has therefore been closed and the Commission will not pursue it anymore,” said the head of investigations.
