Former Finance minister David Mwiraria will appear in court on
November 23 to plead to charges in the Sh10 billion Anglo Leasing case.
The court made the ruling after a doctor’s report indicated that Mr Mwiraria can stand trial.
Mr
Mwiraria is among 10 people charged with conspiracy to defraud the
government of billions of shillings through dubious security contracts.
The
others, who have already pleaded, are Kisii Senator Chris Obure, former
Postmaster-General Francis Chahonyo, former Transport PS Sammy Kyungu
and former Finance Secretary Samuel Bundotich.
Former
Security PS Dave Mwangi, former Finance PS Joseph Magari, former head of
debt management David Onyonka and businessmen Deepak Kamani, Rashmi
Kamani and Chamanlal Kamani were also charged. They denied the charges.
Mr
Mwiraria is accused in the first two cases of conspiring with the
others to defraud the government between July 2003 and June 2004.
He,
Mr Mwangi, Mr Magari and Mr Onyonka are facing other charges of abuse
of office, failure to comply with procurement rules and engaging in the
project to modernise the police security system without proper planning.
In
the second case, Mr Mwiraria, Mr Mwangi, Mr Magari, Mr Onyonka, Rashmi
Kamani, Deepak Kamani, Bradley Birkenfeld and Infotalent Ltd are accused
of conspiring to defraud Sh6.5 billion through police computerisation
projects, code named e-cops.
Rashmi Kamani, Deepak
Kamani and Infotalent Ltd are said to have received over Sh180 million,
paid by the government to their account held at HSBC Republic Bank of
Switzerland.
