The Supreme Court has reinstated Peter Munya as Governor of Meru County pending the hearing and determination of his appeal.
The
court also barred the Independent Boundaries and Electoral Commission
from swearing in the County Speaker to stand in as acting Governor.
Supreme
Court judges Jackton Ojwang and Smokin Wanjala had earlier stopped IEBC
from declaring the seat vacant, pending their decision on whether to
stay the stay the execution of the Court of Appeal judgement.
The Court of Appeal in Nyeri nullified his election on March 12 on grounds that it did not meet the constitutional threshold.
The
court noted that the High Court ordered scrutiny and recount of votes
in seven out of 953 polling stations and that the differences that
emerged could have altered the results.
