Deputy President William Ruto returned to the country on Saturday evening after the International Criminal Court granted him an excusal for three days as President Uhuru Kenyatta prepares to head to Rwanda for a regional summit on Monday.
The trial of Mr Ruto will proceed for the first time in his absence. The excusal is historic since for the first time, the accused will not be present in the courtroom to attend the trials as required by Article 63 (1) of the Rome Statute. (READ: ICC grants Ruto leave from trial next week)
The Deputy President had preferred to have his trial continue in his absence as opposed to the African Union’s request to the Security Council for a deferral. The Appeals Chamber declined to excuse Mr Ruto from continuous attendance at his trial, reversing the June 18 decision by the ICC Trial Chamber that conditionally excused Mr Ruto from being physically present during the sessions. On October 21, Kenya’s permanent representative to the UN Macharia Kamau had approached the Security Council for deferral after the AU’s extra-ordinary summit on October 11 and 12 in Addis Ababa, Ethiopia. (READ: UN envoy chastises ICC over deferral of Kenyan cases)
