IN SUMMARY
  • Police have recommended that Mr Nyagah and five of his associates be charged, but have left the door open for more arrests.
  • Police say in a report Mr Havi colluded with Mr Nyagah to make illegal changes to Purple Saturn’s directorship to aid in a land fraud scheme.
Foreign shareholders of the multi-billion shilling Tatu City development project want the High Court to lift an order barring the arrest of former Central Bank of Kenya governor Nahashon Nyagah’s lawyers over an alleged Sh5.3 billion land scam.
investigations are completed.“The interested parties are the complainants in the matter and it is only fair that they be heard on why this matter should proceed or not. I will require 14 days to file a reply and grounds of opposition to the suit,” Rendeavour and Mr Jennings’ lawyer Ahmednasir Abdullahi said on Wednesday.
Mr Nyagah’s lawyers claim in court papers that Mr Jennings did not have authority to file a complaint on behalf of Purple Saturn, the Tatu City subsidiary that holds land for the project.
They hold that Purple Saturn’s board of directors have not passed a resolution to allow the New Zealand national to file a police complaint and that the investigations are consequently unconstitutional.
“I verily believe that the Inspector-General of Police and the CID Director have suppressed Purple Saturn’s complaint and instead hurriedly dealt with the complaint of Mr Jennings, and decided that I, Mr Osundwa among others should be charged,” Mr Havi says.
The lawyer said he only acted in his professional capacity in effecting the shareholding capacity, and that it would be unfair to charge him and Mr Osundwa over the matter.
Police say in a report Mr Havi colluded with Mr Nyagah to make illegal changes to Purple Saturn’s directorship so that he could put in place the alleged land fraud scheme.
Lady Justice Ngugi will mention the matter on September 21.
